Toby is a partner in the Dispute Resolution Department and co-heads the firm's cross practice Investigations Group.
He has acted for a number of clients on a wide variety of commercial disputes and investigations. His practice covers a broad range of contentious work from cases involving allegations of fraud, to shareholder disputes, investigations (internal and regulatory), the enforcement of judgments and arbitral awards and competition litigation.
Toby has, since 2013, led the team acting for Hewlett Packard Enterprise in relation to fraud claims amounting to US$4 billion, with parallel criminal proceedings in the US, arising out of the US$11 billion acquisition of Autonomy Corporation plc in late 2011. After a 10-month trial in 2019, Hildyard J handed down his 1,650 page judgment in May 2022 in which he found that the HP claimants had been defrauded by the former CEO and CFO of Autonomy.
In 2012, he was seconded to the Royal Bank of Scotland for six months as Acting Head of Litigation, Regulatory and Investigations dealing exclusively with contentious regulatory issues.
He recently featured as one of The Lawyer magazine’s Hot 100 lawyers. The Hot 100 is an annual publication which celebrates extraordinary lawyers based in the UK who have completed ground-breaking work in the last year. He is also recognised in the 2024 edition of "Best Lawyers in the United Kingdom".
