New Zealand Supreme Court releases Smith v Fonterra & Ors decision on novel climate change claims
In a unanimous judgment, the Supreme Court of New Zealand has overturned the Court of Appeal's decision, which struck out Mr Smith's three tortious claims against seven corporate defendants (read our previous briefing here). The Supreme Court has allowed Mr Smith's claims in negligence, public nuisance, and a novel "climate system damage" tort to proceed to trial.

Significant changes announced for sponsored work visas effective 4 April 2024
Further to the Government's announcements of planned changes to UK Immigration Rules aimed at reducing net migration, more details have now been released in relation to the upcoming changes, which are set to take effect from 4 April 2024. Extraterritorial reach of CMA information gathering powers: the fight continues?
On 17 January 2024, the Court of Appeal found that the UK Competition and Markets Authority ('CMA') has the power to require overseas companies to produce documents and information as part of its competition law investigations (CMA v BMW and VW), overturning an adverse Court judgment last year which had threatened the ability of the CMA to effectively investigate cross-border cartel conduct post-Brexit.
